Why do people get a legal separation?
Legal separation can allow couples to protect some of the benefits of being married while pursuing separate lives without the financial liabilities of marriage. Some couples choose legal separation to preserve medical insurance or some other material benefit that might terminate if they became divorced. Others, while accepting that their marriage is over, choose legal separation over divorce for religious reasons. If you are considering a legal separation, contact us to protect your rights.
What is the effect of a legal separation?
If you decide to get a legal separation, the effect will be the same as a divorce, except neither party can get remarried. Your legal separation will include the same legal components of a divorce in terms of the division of property, And, if you and your spouse have children together, you will also deal with the legal issues of child custody and visitation, and child support. Washington residents should keep in mind, however, that six months after the Court enters a Decree of Legal Separation, either spouse may have the decree converted to a Decree of Dissolution of marriage, thus effectively transforming the legal separation to a divorce.
Do I need a legal separation?
If you are currently living away from your spouse and are considering a divorce or feel that you are “separated,” a legal separation allows you to protect your rights through a legal process.
