The Court will enter a Parenting Plan in every Divorce with children, and a Residential Schedule in every Parentage action. After these legal proceedings are over, and a final Decree or final court orders have been entered, parents may still petition the Court in the future to modify the Parenting Plan or Residential Schedule. Such a modification request is always decided by the Court on the basis of what is in the “best interest of the child.” Washington courts will not consider such a modification unless the parent seeking it can show that there has been a “substantial change in circumstances” that necessitates such modification.

What is a parenting plan modification?

A Parenting Plan modification involves the Court changing the existing provisions of the Parenting Plan that was put into effect when your divorce, legal separation, or parentage action was made final. Such a modification can be as minor as changing the specific days or hours when the noncustodial parent will have the child, or can be as major as a complete transfer of custody of the child from one parent to the other. Most, but not all, Parenting Plans in Washington require the parents to try to resolve disputed issues in mediation prior to seeking a Parenting Plan modification in Court.

Does a parenting plan modification affect child support?

A Parenting Plan modification, especially a major modification, will generally require a modification of the Order of Child Support.
